Job Description

  • Proactively contributes to the Health and Hospital Corporation of Marion County’s mission:  Promoting and protecting the health of everyone in the community and providing health care to those who are underserved.

     

  • Provides development, guidance, and assists in the identification, implementation, and maintenance of Health and Hospital Corporation and Marion County Public Health Department’s information privacy policies and procedures.

     

  • Works with Health and Hospital Corporation and Marion County Public Health Department’s senior management and corporate security officer to establish and lead an organization-wide HIPAA team.

     

  • Performs initial and periodic information privacy risk assessments and conducts related ongoing compliance monitoring activities in coordination with Health and Hospital Corporation and Marion County Public Health Department’s other compliance and operations assessment functions.

     

  • Works with management, departments, and committees to ensure the organization has and maintains appropriate privacy and confidentiality consents, authorization forms, information notices and materials reflecting current organization and legal practices and requirements.

     

     

  • Oversees, directs, delivers, or ensures delivery of privacy training and orientation to all employees, volunteers, contractors, business associates and other appropriate third parties.

     

  • Participates in the development, implementation, and ongoing compliance monitoring of all trading partner and business associate agreements to ensure all privacy concerns, requirements, and responsibilities are addressed.

     

  • Establishes, in coordination with the information security officer, a mechanism to track access to protected health information, within the purview of the organization, and as required by law, and to allow qualified individuals to review or receive a report on such activity.

     

  • Works cooperatively with departments in overseeing patient rights to inspect, amend and restrict access to protected health information when appropriate.

     

  • Works cooperatively with the Quality Committee, Research and Review Committee, Forms Committee, TB Outbreak Response Committee and all other relevant committees.

     

  • Establishes and administers a process for receiving, documenting, tracking, investigating, and taking action on all complaints concerning Health and Hospital Corporation and Marion County Public Health Department’s privacy policies and procedures.

     

  • Ensures compliance with privacy practices and consistent application of sanctions for failure to comply with privacy policies for all individuals in Health and Hospital Corporation and Marion County Public Health Department’s workforce, extended workforce, and for all business associates, in cooperation with Human Resources, the information security officer, and General Counsel as applicable.

     

  • Initiates, facilitates and promotes activities to foster information privacy awareness within the organization and related entities.

     

  • Interacts with the information security officer in review of all system-related information security plans throughout Health and Hospital Corporation and Marion County Public Health Department’s network to ensure alignment between security and privacy practices.

     

  • Maintains current knowledge of applicable federal and state privacy laws and accreditation standards, and monitors advancements in information privacy technologies to ensure organizational adaptation and compliance.

     

     

  • Coordinates audit process of business partners.

     

  • Documents, reports, and investigates self-disclosures of any evidence of privacy violations.

     

  • Ensures adequate steps are taken to correct identified problems and prevent their re-occurrence.

     

  • Represents Midtown in mental health commitments and guardianship proceedings, and performs other legal work as requested by the Legal department.

     

  • Assists in preparing employees for trial or depositions.

     

  • Represent and provide legal advice to Health and Hospital Corporation and Marion County Public Health Department staff members in all departments, including performing research and drafting memoranda or other necessary documents.

     

  • Drafts contracts, memorandums of understanding and conducts legal review of agreements and proposals.

     

  • Performs other duties as assigned by General Counsel, including, but not limited to the following:

    • Participation in safety inspections

    • Investigation of claims or potential claims against Health and Hospital Corporation and Marion County Public Health Department

    • participation on Health and Hospital Corporation and Marion County Public Health Department committees

    • Respond to insurance-related questions

    • Working knowledge of self-insurance trust fund

    • Perform like duties upon request for Wishard Health Services

       

  • Issue periodic reports to HHC’s General Counsel and other as he/she designates regarding HIPAA compliance and problem areas related thereto.

     

  • Create, organize, and oversee appropriate committees, including instituting performance benchmarks.

     

  • Chair HHC’s Fleet Committee.  Manage and coordinate all matters relating to HHC’s automobile fleet, including evaluation and settlement of claims, collection of unpaid or uncollectible money owed to HHC, revision and implementation of HHC’s “Driver Policy” and “Random Drug Testing Policy”, and fleet litigation if necessary.

     

Job Requirements

  • License to practice law in the state of Indiana

  • Knowledge of HIPAA regulatory standards, trends, and changes.

  • Knowledge of research standards and regulatory requirements. 

  • Demonstrates knowledge and practice of efficient, customer-focused operations.

  • Demonstrates effective and appropriate critical thinking skills and decision-making abilities consistent with the mission and vision of Health and Hospital Corporation and Marion County Public Health Department.

  • Demonstrates strong leadership, interpersonal, and problem-solving skills.

  • Demonstrates knowledge of federal and state regulations applicable to clinical research.

  • Demonstrates knowledge of federal and state regulations applicable to privacy.

  • Demonstrates knowledge of federal and state regulations regarding public health and health law in general.

  • Analytical skills and ability to understand operational processes and technology concepts.

  • Demonstrates initiative, self-motivation, practical learning skills, enthusiasm, and an ability to complete multiple tasks in a timely and accurate manner.

  • Demonstrates a proven ability to work with all levels of management.

  • Demonstrates professional and effective verbal and written communication skills. 

  • Demonstrates the ability to effectively establish positive working relationship with other HHC/MCPHD departments.

     

SKILLS, ABILITIES AND KNOWLEDGE TYPICALLY ACQUIRED THROUGH:

  • A Juris Doctorate degree

  • A minimum of five years of healthcare regulatory experience

  • A minimum of five years’ experience in healthcare and privacy laws, access, and release of information

  • Litigation experienced preferred
